Terms of Use

These terms are an agreement between you and REQWRECK ("REQWRECK," "we," "us"). They cover your use of our website and any list you buy from us. By using the website or placing an order, you agree to these terms and to our Privacy Policy. If you're ordering for an agency or other business, you confirm you're allowed to agree for that business, and "you" includes the business.

1. What REQWRECK provides

REQWRECK delivers lead lists for staffing and recruiting agencies. Each list covers one metro area. It shows employers with job postings that have been open about 30 to 60 days, details about those jobs, and a hiring contact at the employer where we can find one. Lists are delivered as a spreadsheet by email and on your private order page.

How many employers and contacts a list has depends on what's posted in your metro at the time. Not every employer has a hiring contact we can find. Each list tells you how many do. We never invent or guess contacts.

2. Plans and prices

• One-Time Wreck: $297, paid once. One metro, one fresh list, no subscription.
• Monthly Wreck: $150 per month plus a one-time $50 setup fee. One metro, with a fresh scan and a new list every billing cycle.

Prices are in US dollars. Payments are processed by Stripe, and you also agree to Stripe's terms when you pay. You're responsible for any taxes that apply to your purchase.

3. Monthly Wreck automatic renewal

We don't give partial refunds for unused parts of a month, except under the guarantee in section 5. If we ever change the Monthly Wreck price, we'll email you at least 30 days before the new price applies, and you can cancel before then.

4. Delivery

Delivered as a spreadsheet by email the same day, usually within a few hours of payment. If your metro's data is more than a few days old, we run a fresh scan first. That can add a short wait, and your order page shows each step. Sometimes a list gets a quick manual check before it goes out, usually within one business day. If we can't deliver a list you paid for, we'll tell you and give you a full refund.

5. Our guarantee

If fewer than 20 of the companies on a list you bought are ones you're not already working with, tell us and you get a full refund for that list. No forms, no questions, no time window. For Monthly Wreck, the guarantee applies to each month's list separately. Apart from this guarantee and failed deliveries, payments are non-refundable.

6. How you may use the lists

We give you a non-exclusive, non-transferable license to use each list inside your own business, to find and contact potential clients for staffing and recruiting services. You agree:

• not to resell, share, publish or give away the lists or their contents outside your business;
• to follow all laws that apply to your outreach. These include the CAN-SPAM Act for email, the Telephone Consumer Protection Act and do-not-call rules for calls and texts, and privacy laws. You also agree to honor every opt-out request you receive;
• to contact people only about legitimate business matters, and never to harass anyone, discriminate against anyone or deceive anyone;
• not to use the lists to build a competing product, and not to scrape, copy or overload our website.

7. Accuracy and disclaimers

Our lists are built from public job postings and third-party business data, and that information changes constantly. A job may be filled or taken down. A contact may change roles or leave. An email address may stop working. We work to keep the data accurate, but we can't guarantee that every item is complete or current. We also don't guarantee any business results, such as replies, new clients or placements.

Except as stated in these terms, the website and the lists are provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the fullest extent the law allows, REQWRECK won't be liable for any indirect, incidental, special, consequential or punitive damages. This includes lost profits, lost revenue and lost business opportunities. Our total liability for any claim related to these terms or our service is limited to the amount you paid us in the 12 months before the claim arose.

9. Your responsibility

You'll defend and indemnify REQWRECK against claims, losses and costs (including reasonable legal fees) that come from how you use the lists or from your outreach, including any violation of section 6.

10. Suspension and termination

We may suspend or end your access, or cancel a subscription, if you break these terms or misuse our data. If we end a Monthly Wreck subscription for any other reason, we'll refund the unused part of the current month. Sections 6 through 9 and 12 continue to apply after your access ends.

11. Our property

The REQWRECK name, logo, website, software, and the way our lists are selected, ranked and put together belong to REQWRECK. Apart from the license in section 6, these terms don't give you any rights in them.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida, and you and we both agree to their jurisdiction.

13. Changes to these terms

If we update these terms, we'll post the new version here and change the effective date. If the changes are significant, we'll email active customers. Changes don't apply to purchases made before the change.
